Important Interim Order of the Cooperative Court that the Housing Society cannot levy maintenance or service charges or from collecting bills as per the area of flat.
The disputants filed the dispute that the maintenance be charged on per unit basis and not on per square feet basis. This statutory order dated 29th April 2020, issued under Section 79 of the Maharashtra Cooperative Societies Act, 1960, was confirmed by the High Court of Bombay in Venus Cooperative Housing Society Ltd Vs. J.Y. Jetwani (ALL MR 2003 (3) 570).
