Notification dated 1.7.2004 remitting stamp duty chargeable on affidavits used for any purposes.
Circular dated 12.5.2015 directing the authorities to abide by the Notification dated 1.7.2004.
Circular dated 8.1.2015 of the State Election Commission that the affidavit and declaration shall not be insisted on stamp paper.
Judgment dated 28.3.2016 of the High Court at Bombay in PIL No.121 of 2014. In the affidavit filed in the said PIL clarified that remission on stamp paper for affidavit is provided for.
Judgment dated 11.10.2021 of PIL No.58 of 2021 of the High Court of Bombay (Aurangabad Bench) referred to in the letter dated 30.10.2024 of IGR.
All the above Notification, Circulars and the Judgments clearly show that the authorities are not implementing the remission of affidavit stamp paper in letter and spirit to avoid burden on the citizens.
Similarly, it is also necessary to create awareness amongst the citizens, the Advocates, and the stake holders.
