Employee right to travel abroad – Denial of Permission – Pendency of Inquiry – Illegal

The son of the petitioner – employee is residing at Singapore.  The petitioner wants to visit Singapore and meet his son for family reasons.  He had applied for permission on 26.9.2024 to travel abroad from 30.10.2024 to 4.11.2024.

Since there was no response, the writ petition was filed.  After receipt of notice, the respondent served charge-sheet on the petitioner on 21.10.2024.  The petitioner is not involved in any criminal case. 

If at all the respondent wants to conduct inquiry, it is free do so but it cannot deny permission.  Such an action is violative of fundamental right of the petitioner guaranteed under Article 21 of the Constitution.
