Commutation of Pension – Restoration of value after 15 years
As per existing Rules, a portion of pension admissible to the government employees at the time of retirement is commuted for lump sum amount. The said amount is recovered monthly from pension for a period of 15 years.
The retired Doctors of UP Medical Department have filed writ petition to stop such recovery since the said commutation pension amount paid at the time of retirement is already fully recovered in 131 months (10 years and 11 months).
Now, the Allahabad High Court has passed an interim stay order dated 25.7.2024 to the recovery in Writ – A No.5617 of 2024 of Dr.Om Prakash Srivastava and others Vs. State of U.P. Thru Addl.Chief Secy. Deptt. Of Finance Lko 3 others
Similarly, the Government of Gujarat had already taken decision to restore commuted value of pension after 13 years vide Government Resolution dated 12.10.2022.
