Recruitment – Online Option for consideration from female category- Care to be taken by the candidate – Bombay High Court
On 17.8.2023, the respondent no.2 had issued an advertisement for various posts of Craft Instructor was issued. The petitioner had applied for the post of Craft Instructor. The petitioner belongs to NT-C female category. She selected “yes” against the option “to be considered under female category”.
On 6.10.2023, the provisional selection list was published. However, the name of the petitioner did not appear in the said list.
The petitioner objected to the list on the ground that some female candidates considered under NT-C category although they did not mark the said option.
By the order dated 15.2.2024, the Maharashtra Administrative Tribunal, Mumbai, had dismissed the Original Application of the petitioiner.
HELD –
The option “Do you want to opt for the post reserved for Ladies?” was admittedly available only for female candidates from open categories. However, the petitioner had not applied from the said open category but applied the option of NT-C female category. As a result, the option of reserved posts for Ladies from open category was not available to the petitioner and therefore, could not be considered from the said category. The Tribunal has accordingly given the finding and no perversity has been shown. Moreover, she was considered from the option of NT-C female category. The petitioner had secured 135.8 marks and the selected candidates from NT-C female category had scored 161.60 marks.
