Bhopal Gas Tragedy – Web Series – Stay sought by two former managers of Union Carbide Co and Right to pre-screening

Web Series – The Railway Men – The Untold Story of Bhopal 1984 – Stay to the release – Order of the Bombay High Court

The appellants were working in UICL at Bhopal as Production and Works Managers.  They were convicted in the year 2010 and their appeals are pending hearing.

The main objection to the release was in respect of depiction of causes / events surrounding the gas leak and same would cause grave prejudice to the appellants in the on-going judicial proceedings.

HELD that Once the trial has been completed and a person has been convicted, the contents of such judgment are in public domain, there was no further possibility of any bias against them at the time of hearing of the Appeal.   Secondly, each episode will carry disclaimer that the series is a work of fiction inspired by real events.

There is no right to pre-screening of the fictional work of web series since it is neither a documentary or narration of true facts.  Moreover, the facts are all in public domain.
