Stray dog bite on public roads – Compensation of Rs.10,000 per tooth mark of dog and Rs.20,000 minimum per “0.2 cm” of wound where flesh has been pulled off the skin. Judgment of PH High Court.
Bunch of 193 writ petitions were filed for compensation to the victims / families of victims for the incidents / accidents on public streets / roads on account of various factors.
Important questions arose for consideration on the doctrine of strict liability of the State, if compensation claim can be made in the writ petition in the absence of any statutory regulations and which agency / authority should be held liable for compensation as also procedure to be followed for computation of compensation.
The Punjab & Haryana High Court had issued the directions in its judgment dated 18.8.2023 in a batch of 193 petitions seeking compensation for injuries or deaths caused by stray or wild animals on public streets and national highways. It has also constituted Committees and issued certain guidelines.
