Minor Custody Litigation Between Maternal Grandparent & Father

Judgment dated 16.10.2026 of the High Court of Bombay, Bench at Aurangabad, in Family Court Appeal No.58 of 2025 of Machindra Kakaji Takle  Vs.   Anil Ganeshrao Karhale

the Family Court allowed the petition filed by the respondent-father (original petitioner) under Section 25 of the Guardians and Wards Act, 1890 read with Section 7(1) (g) of the Family Courts Act, 1984, and directed the appellant to hand over the custody of the minor girl child, Arohi, (hereinafter referred to as “the child”) to the respondent. However, it is a matter of record that as on today the custody of the child is with her maternal grandfather i.e. the present appellant.
