Salutary PIL – Public Interest Litigation for disclosure of unauthorised construction at the time of contesting elections to local authorities

In today’s newspapers, there is a news about the PIL filed by Shantanu Nandgude resident of Pimpri Chinchwad Pune for disclosure in the nomination form or on affidavit by a candidate contesting elections to the local authorities.   Reference to the order of May 2002 of the Supreme Court for disclosure of criminal antecedents in the nomination form / affidavit by candidate contesting elections to Lok Sabha / Assembly.  It is seen that PIL No.45 of 2022 came up for hearing on 6.9.2023 before the Hon’ble Division Bench.

In some of the local Acts there is a provision of disqualification of elected representatives of local authorities on the ground of unauthorised construction.  However, prevention is better than cure. 

I think that such a disclosure is essential to nip in the bud the menace of illegal / unauthorised construction in each and every part of the State.
