Section 46 IT Act – Cyber Fraud of High Ranking Official – Interim Order of Adjudicating Officer
Complainant – global cybersecurity, information security, and ISO auditing firm has initiated the adjudicating proceedings under Section 46 of the Information Technology Act.
The respondent was the Head of Partnerships Senior Vice President employee of the complainant for five years and was terminated in 2025 for professional misconduct.
Respondent was entrusted with privileged administrative access to highly sensitive corporate repositories, including client databases, lead information, proprietary pricing models, and financial billing details. Upon termination, the Respondent surrendered his official company-provided laptop (HP Pavilion Plus) to the management.
In a routine annual IT Asset Audit conducted on February 26, 2026, a technical examination of the surrendered laptop revealed that the Respondent had actively engaged in unauthorized data exfiltration during and after his employment. The technical audit, mapped through digital perimeter monitoring logs (‘we360’) and an active WhatsApp Web session linked to the Respondent’s personal mobile number, conclusively established unauthorized transmissions.
Adjudicating Authority hereby passes an INTERIM ORDER directing that both the Complainant and the Respondent are strictly restrained and prohibited from accessing, utilizing, disseminating, or exploiting each other’s proprietary data, the specific data which is currently in dispute, confidential business information, or internal communications in any manner whatsoever, pending the final adjudication and formal disposal of this matter by this Court.
