Compensation Even for Service Road in Highway Land Acquisition
Judgment dated 12.6.2026 of the High Court of Bombay, Bench at Aurangabad, in Writ Petition NO.1986 of 2016 of Youvraj Namdeo Khaladkar and others Vs. The National Highways Authority of India and others
ON 3.11.2014, the final award for compensation of Rs.54,47,000/- for the land of the petitioner acquired for widening of the National Highway No.11 Dhule Solapur Road was passed. However, the respondent no.3 refused to pay entire compensation on the ground that the area of 2168 sq.meter was acquired for service road and compensation is not payable for the service road.
Bombay HC Reinforces the principle that public purpose land acquisition cannot override Article 300A Right to Property including right to compensation for the land acquired for service road for public use.
Bombay HC Clarifies that compensation must cover all acquired land including area earmarked for service roads or utilities for public use.
Bombay HC – Reservation and Acquisition of land for public use like service roads does not extinguish proprietary rights of the land owners.
