The High Court has set-aside the selection and appointment of the appellant for want of essential qualification of 5 years’ experience and therefore, no preference could have been given for her M.Tech degree.

Higher or Superior Academic Qualification cannot substitute or override a mandatory requirement of minimum work experience. The authority cannot treat a higher qualification as an implied equivalence or relaxation of essential criteria of work experience.
Preference for Higher Qualification Operates only amongst Eligible Candidates. There is a distinction between “essential” and “preferential” qualifications
Preference for higher qualification operates only within the zone of candidates who have already fulfilled the essential eligibility conditions.
Therefore, unless a candidate is first found eligible, the question of granting preference does not arise at all
