Withholding of Pension Pending Caste Claim

it is clear that if there is no adjudication of caste claim of the employee during his service tenure, the Department cannot withhold pension of such retired employee like the petitioner in this case. Moreover, the State of Maharashtra vide Government Resolution dated 14.12.2022 has made it clear that the employee shall not be deprived of retiral benefits even though his caste claim is invalidated.
