Bombay HC – Section 17A of the Prevention of the Corruption Act – Cannot Be Misused as shield in Disproportionate Assets Case – Role of Competent Authority is limited

Corruption is an enemy of the nation and tracking down corrupt public service, howsoever high he may be, and punishing such person is a necessary mandate of the Prevention of Corruption Act, 1988.

Corruption corrodes the moral fabric of the society and corruption by the public servants not only leads to corrosion of the moral fabric of the society but is also harmful to the national economy and national interest.

By the order dated 25.4.2019, the then Municipal Corporation of PMC had rejected sanction sought by the ACB for the open inquiry and refused to grant previous approval.  In view of this, the ongoing confidential enquiry of the City Engineer was closed.
