Supreme Court Strengthens Jurisprudence of Service Law on Fairness and Due Process in Disciplinary Inquiry

 

The appellant – employee of U.P. Cooperative Federation Ltd – was dismissed from service and sought recovery of Rs.9,53,433/-.

no witness was examined in the enquiry. However, it is contended that in response to the charge of not supplying 1093.66 quintals of paddy to M/s. Pashupati Nath, the reply of the appellant was evasive and, therefore, it amounted to admitting the charge. Hence, it was not necessary to produce any witness to prove the charge as under Section 58 of the Evidence Act, 1872, facts admitted need not be proved.
