Bombay HC Ensures Compensation for Covid Death of Court Employee
Compensation for Covid-19 Death of Employee of Civil Court after cut-off date of 30.6.2021.
Deceased employee was on duty during 24th to 31th May 2021 and thereafter, on vacation from 1st to 6th June, 2021.
On 7.6.2021, the deceased was not feeling well and started treatment of the doctor. In the test of 14.6.2021, he was found covid-19 positive, he was admitted in the hospital till 3.7.2021 when he succumbed to Covid-19.
HELD that the cut off date of 30.6.2021 as prescribed in the Government Resolution dated 25.4.2022 cannot be regarded as sacrosanct.
To deny or restrict the relief to those who passed away after 30th June 2021 would be contrary to the values of justice, fairness, and dignity which animate our constitutional order, and also contrary to public conscience and societal gratitude. The hardships faced by these workers and their families during the pandemic were immense and deserve recognition beyond mere symbolic gestures
