Bombay HC Quashes Mutation Entry Declaring College Land as Private Forest – Mahindra United World College Case
In 1996, the petitioner purchased the lands at Khubawali Taluka Mulshi District Pune, NA permission was granted in 1996, mutation entries were also effected in the name of the petitioner as owner and after construction of the premises, the college was started in 1997 97.
The College campus of the petitioner’s on the lands includes hostels, buildings for sports and medical facilities and hundreds of students are enrolled every year to study since 1997.
On 7.3.2001, the Mutation entry deleting the name of the petitioner in respect of the said lands of the petitioner was taken, the name of the in respect of the lands at village Khubawali Taluka Mulshi District Pune, deleting the name of the petitioner and recording the remark of “private forest”, without notice to the petitioner.
On 4th April 2015, a response with respect to the RTI Application was issued and inter alia stated that “At present, the said 35(3) notice is not found in the available office record”.
