Bombay HC – Magistrate has no Powers to Order YouTube Takedowns in Defamation videos
The petitioner – charitable Trust and NGO filed the petitions for removal of defamatory videos on YouTube Platform – social media intermediary operated by Google LLC.
By the order dated 31.3.2023, the Magistrate allowed the application of the petitioner, directed the respondent no.1 to stop and remove circulation of defamatory videos and respondent no.2 to enter into correspondence with Google to comply with the Rules framed under the Information Technology Act, 2000.
Information Technology (Procedure and Safeguards for Blocking for access of Information by Public) Rules, 2009.
Rule 10 of the Rules is not the source of power of a Magistrate to pass an order to block the information or circulation of any information on social media platform.
